In the 1967 Outer Space Treaty, the Moon was declared the “province of all mankind.” Yet, this treaty was a relic of Cold War stalemate, designed to prevent the militarization of space by superpowers who could not yet effectively occupy it. When the cost of access to orbit drops, the sovereignty of the nation-state becomes secondary to the logistical sovereignty of the corporation. In reality, they are seeking the total deregulation of an environment where the absence of a social contract allows for the imposition of a corporate one. They do not want to go to the Moon to liberate humanity; they want to go to the Moon to escape the regulatory burdens and social overhead that centuries of labor struggle have forced upon capital on Earth.

The paradox here is sharp: the more we treat space as a sacred, neutral territory, the more we invite a "tragedy of the commons" enacted by whoever moves fastest. History offers a grim parallel in the Scramble for Africa. The Berlin Conference of 1884 was ostensibly about "civilizing" the continent and ensuring free trade; in practice, it provided the legal and diplomatic framework for total appropriation. When space is framed as a "frontier," it is already mapped as a commodity. We are currently in the era of the chartered company, mirroring the 17th-century Dutch East India Company, which possessed the legal authority to wage war, mint currency, and establish colonies under the guise of commercial enterprise. To believe that the Moon can be kept neutral while we allow the same economic structures that devastated Earth to pilot our rockets is a profound category error.

If we look at the history of the commons, we find that they survive only when they are aggressively defended by the local populations whose lives depend on them. But there is no local population on the Moon. There is only the investor. By separating "space" from the terrestrial struggles of political economy, we have created a domain where capital can operate without the "friction" of human rights, environmental regulation, or public accountability.

We are not choosing between public heritage and private plunder; we are choosing between an explicit imperial expansion led by states and a stealthier, more efficient colonization led by corporations. Both systems necessitate the commodification of the celestial. If we do not fundamentally rethink the nature of ownership and the ethics of resource extraction—moving beyond the archaic logic of "discovery" and "development"—we will simply extend the reach of our contradictions into the stars.

The question is not whether the Moon should be privatized or kept neutral. The question is: why do we imagine that humanity, which has never succeeded in stewarding a shared resource on our own planet, will suddenly find the moral maturity to govern another world without first turning it into a mirror of our own inequality?
